Independent Singapore VCC guidance
Direct answer
A family trust should map digital-asset access without placing private keys, seed phrases or authentication secrets in the governance file. First prove which assets are trust property and how each custodian or wallet is controlled. Then separate the authority to decide, initiate, approve and verify a transfer. Document an emergency route for death, incapacity, provider failure and compromised access, with independent identity checks and recovery tests. The trustee should retain ownership, valuation, transaction and provider evidence while secrets remain protected through the chosen custody design.
At a glance
- Ownership evidence and access credentials are different records and should be controlled separately.
- Every wallet or account needs a named decision, initiation, approval and verification route.
- Emergency access must be tested without exposing the live secret.
- Trustee, protector, custodian and family-office roles should not overlap by accident.
Who this is for
- Singapore-connected family trusts holding or considering digital assets through wallets, exchanges or professional custodians.
Important exclusions
- A recommendation to buy digital assets, a custody provider endorsement or legal interpretation of a trust deed.
Prove the asset and ownership perimeter
Create an inventory that identifies each token or digital right, network, wallet or account, custodian, legal owner, beneficial context, acquisition record and supporting trust document. The inventory should distinguish an asset personally owned by the settlor, an asset transferred to the trustee, an interest held through a company, and a service account that only provides access. Reconcile transaction evidence, provider statements and accounting records without copying secret credentials. Record assets that the trustee has not accepted or cannot yet control. MinLaw explains that a trustee holds and manages trust property for beneficiaries under the trust terms, so the operational file must be capable of showing what property actually sits within that responsibility rather than relying on family recollection.

Separate custody from decision authority
For each holding, map the trustee, protector where relevant, investment adviser, family-office staff, custodian, wallet operator and beneficiary communication role. A person who recommends a trade should not automatically control the transfer credential. A custodian instruction should identify the authorised trustee signatories and any dual approval, while a self-custody arrangement needs an equivalent separation using the chosen technical and legal design. Check the trust deed and provider agreement before assigning emergency powers. Document which decisions need trustee judgment, which are delegated, which require consent and which are purely operational. A role matrix should also show who can remove or replace a user, reset authentication, change a withdrawal address or move assets after a security incident.

- Separate investment recommendation, transfer initiation, approval and post-transfer verification.
- Record protector or committee consent only where the governing terms require it.
- Control user creation, credential reset and withdrawal-address changes.
- Prevent any single family-office employee from holding every access step.

Design an emergency access route
Plan for death, incapacity, loss of a device, compromised authentication, unavailable signatory, provider suspension and a blockchain or network incident. For each scenario, state who declares the event, what evidence is needed, which access route activates, who observes the recovery and how transfers are limited until control is confirmed. The plan should avoid a sealed envelope that becomes both obsolete and dangerous. Use the custody method chosen with qualified advisers to divide recovery information and approvals while keeping a non-secret governance record of the process. Test the route in a safe environment or with a controlled provider procedure, record the result and correct gaps. An emergency plan that has never been exercised may fail when the family cannot afford experimentation.

- ContainRestrict transfers, preserve logs and protect unaffected accounts while facts and credentials are checked.
- RecoverUse the approved multi-person or provider route without exposing more secret material than necessary.
- ReconcileConfirm assets, permissions, transactions, devices and supporting evidence before restoring ordinary access.

Keep evidence without keeping secrets
The trustee file should retain acquisition records, ownership and transfer documents, wallet or account identifiers, provider contracts, authorised-user lists, valuation support, transaction approvals, statements, incident records and recovery-test evidence. It should not contain a complete private key, seed phrase, password or authentication token. Apply restricted access and version control to the authority matrix because it reveals sensitive operational relationships even without the secret. Reconcile on-chain or provider records to the trust accounts and investigate unexplained movements. Keep a record of who viewed or changed access-control documents. When a provider or device changes, close old permissions and preserve enough evidence to explain the migration. This gives the trustee an auditable chain without turning the governance archive into the easiest path to theft.

- Exclude complete credentials and recovery secrets from minutes and ordinary document repositories.
- Restrict and log access to authority and custody records.
- Reconcile asset movements to trustee approvals and accounting entries.
- Close obsolete users, devices, addresses and provider permissions after change.

Review providers and succession readiness
Assess whether the chosen custodian or wallet arrangement supports the trust legal owner, multiple authorised persons, auditable approvals, geographic access, succession, incident support and record export. Confirm who contracts with the provider and what happens if the relationship ends. Do not assume a familiar exchange account can simply become a trustee account. Review the plan after a change in trustee, protector, family-office staff, device, custodian, governing document, asset type or beneficiary circumstances. Include digital assets in the broader trust asset register and succession discussion rather than treating them as a private hobby of one family member. The final review should leave the trustee able to explain ownership, access, authority, safeguarding, valuation and recovery without revealing the secret itself.

Frequently asked questions
Should the trust deed contain a seed phrase?
No. The governance documents can describe the custody and recovery process, but complete keys, seed phrases and live authentication secrets should remain protected through the chosen security design, not copied into ordinary records.
Can a beneficiary hold the only wallet credential?
That arrangement can defeat trustee control and continuity. Review ownership, governing terms and custody with qualified advisers, then separate beneficiary communication from the trustee authority and operational access needed to safeguard trust property.
How often should emergency access be tested?
Use a planned cycle and retest after material changes in people, providers, devices, custody method or governing documents. The test should prove the process without exposing or moving live assets unnecessarily.
What should happen when the trustee changes?
The handover should reconcile ownership, accounts, addresses, users, approvals, devices, provider contracts, recovery routes, transaction history and accounting evidence. Old access should be revoked only after the replacement control is verified.
